Legally binding terms for using the BRIK64 website, closed beta access flow, public materials, and shop.

Acceptance and eligibility

The website located at brik64.com and related public BRIK64 web surfaces are operated by BRIK64 Inc.. By accessing or using the site, requesting beta access, submitting information, or buying shop products, you accept these Terms on behalf of yourself or the entity you represent.

Please read these Terms carefully before using the site. These Terms govern the information, text, reports, templates, examples, chat or automated features, shop pages, beta access flows, downloadable materials, and other materials made available through the site.

You represent that you have the right, authority, and capacity to agree to these Terms. You may not use the site if you are under 18 or if you do not agree with these Terms.

BRIK64 may update these Terms at any time by posting revised terms on the site. Continued use after revised terms are posted means you accept the revised terms.

No legal, tax, accounting, or professional advice

The site may provide general information, examples, templates, technical materials, policy text, or self-help materials. Those materials are not legal, tax, accounting, security, compliance, engineering, or other professional advice and are not a substitute for qualified professional counsel.

Materials on the site may be incomplete, may not reflect recent developments, and may not apply to your jurisdiction or circumstances. You should not act or refrain from acting based only on BRIK64 public materials.

No professional relationship or confidentiality

Using the site, sending messages, submitting beta requests, interacting with chat or automated features, or using public materials does not create an attorney-client, fiduciary, advisory, consulting, or other professional relationship with BRIK64.

Do not send confidential, privileged, regulated, secret, or sensitive information through public forms, chat features, beta requests, or support channels unless BRIK64 has agreed in writing to receive that information. Public-site communications are not privileged and may not be confidential.

Accounts and closed beta

Certain features require an approved account. During closed beta, access is invitation-only. Requesting access does not create an account, guarantee approval, guarantee availability, or require BRIK64 to provide service.

You are responsible for accurate account information, keeping credentials confidential, and all activity under your account. BRIK64 may suspend or terminate access if we believe these Terms were violated, access creates risk, or continued access is not appropriate.

Limited site license

Subject to these Terms, BRIK64 grants you a limited, revocable, non-exclusive, non-transferable right to access and use the public site for lawful evaluation, communication, beta access requests, and shop purchases.

No part of the site may be copied, reproduced, distributed, republished, downloaded, displayed, posted, transmitted, modified, reverse engineered, or commercially exploited except as expressly allowed by BRIK64 or applicable law.

Restrictions

You may not misuse the site or public materials. The rights granted to you do not include any right to build a competing service from non-public materials, bypass access controls, remove proprietary notices, or imply endorsement by BRIK64.

  • Do not attack, disrupt, overload, scrape at abusive scale, credential-stuff, spam, phish, upload malware, or interfere with site security.
  • Do not submit unlawful, infringing, defamatory, abusive, harassing, obscene, misleading, harmful, or privacy-invasive content.
  • Do not collect other users' information without consent, generate automated accounts, or use automated agents in a way that harms reliability.
  • Do not use site materials to directly or indirectly create, train, develop, fine-tune, benchmark, or improve proprietary or third-party machine learning, large language model, or artificial intelligence services without written permission.
  • Do not use BRIK64 materials to make unsupported certification, compliance, safety, formal-proof, or production-readiness claims.

Materials, templates, downloads, and forms

BRIK64 may make examples, templates, reports, snippets, downloadable files, or forms available for informational use. You may use those materials only for your own personal or internal business evaluation unless a separate license allows broader use.

You may fill in authorized forms or templates for your permitted use, but you may not resell, redistribute, host, publicly display, frame, commercially exploit, remove notices from, or create derivative materials from BRIK64 materials unless BRIK64 permits it in writing or an applicable open-source license allows it.

User content and feedback

You are responsible for information, content, files, feedback, suggestions, reports, or other materials you submit through the site or approved beta workflows. You must have all rights needed to submit that material.

You grant BRIK64 a worldwide, non-exclusive, royalty-free license to host, reproduce, process, display, and use submitted content as needed to operate, secure, provide, improve, and support the site and related workflows.

Feedback is non-confidential unless a signed agreement says otherwise. BRIK64 may use feedback, ideas, suggestions, and reports without restriction or compensation.

BRIK64 has no obligation to pre-screen, store, preserve, transmit, or return user content. We may monitor, refuse, remove, disclose, or preserve content where reasonably needed to operate the site, enforce these Terms, respond to support or legal requests, protect rights and safety, or comply with law.

Automated features and recordings

If BRIK64 offers chat, automation, AI-assisted, voice, or interactive support features, those features may be automated and may produce incomplete, inaccurate, outdated, or unsuitable output. You are responsible for independently reviewing any output before relying on it.

Interactions with the site, support flows, chat features, or communications may be logged, recorded, monitored, analyzed, or reviewed for security, quality assurance, research, development, abuse prevention, support, and business operations as described in the Privacy Policy.

Ownership

BRIK64 names, marks, logos, website design, copy, diagrams, software, documentation, public materials, non-public beta materials, and related intellectual property are owned by BRIK64 Inc. or its licensors.

Open-source components, repositories, or packages remain governed by their applicable license files. These Terms do not reduce rights granted by an applicable open-source license.

Third-party services

The site may link to or use third-party services for hosting, security, payments, fulfillment, analytics, email, documentation, support, or integrations. Third-party terms and privacy policies apply to third-party services.

BRIK64 is not responsible for third-party websites, advertisements, services, content, failures, or transactions outside BRIK64 control.

Copyright policy

BRIK64 respects intellectual property rights and may remove allegedly infringing material or terminate access for repeat infringers where appropriate.

Copyright notices should identify the copyrighted work, the material claimed to infringe, enough information to locate it, a good-faith statement, an accuracy statement under penalty of perjury, the requesting party's contact information, and a physical or electronic signature. Use the website contact path for copyright notices.

Disclaimers

The site, public materials, beta access, and shop pages are provided on an as-is and as-available basis. To the fullest extent permitted by law, BRIK64 disclaims warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, non-infringement, uninterrupted availability, security, legality, safety, and error-free operation.

Public website text is not a warranty, audit, certification, legal opinion, security report, compliance report, or formal proof. Technical claims require their own evidence, scope, and applicable agreement.

Limitation of liability

To the maximum extent permitted by law, BRIK64 and its suppliers will not be liable for lost profits, lost data, procurement of substitute services, business interruption, or indirect, consequential, exemplary, incidental, special, or punitive damages arising from or relating to these Terms or site use.

To the maximum extent permitted by law, BRIK64's aggregate cumulative liability for claims arising from or related to these Terms or the site will not exceed one hundred U.S. dollars.

Indemnification

You agree to indemnify and hold BRIK64, its officers, employees, agents, suppliers, and affiliates harmless from claims, demands, costs, and attorneys' fees arising from your site use, your content, your violation of these Terms, or your violation of law or third-party rights.

Disputes, arbitration, and class waiver

Before starting arbitration or litigation, each party must try in good faith to resolve disputes informally. A party initiating informal dispute resolution should send notice through the website contact path and include enough information to identify the dispute and requested relief.

Except for claims that may be brought in small claims court, claims seeking equitable relief for intellectual property misuse, or claims that cannot be arbitrated under applicable law, disputes arising from these Terms or the site will be resolved by binding arbitration under the Federal Arbitration Act and JAMS rules. The arbitrator may award individual relief available under applicable law.

You and BRIK64 waive the right to a jury trial and agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, collective, representative, or mass action, except where applicable law does not allow such waiver.

If 10 or more substantially similar arbitration demands are filed by or with the assistance of the same law firm, group of law firms, or organizations within a 90-day period, BRIK64 may require batch arbitration procedures to improve efficiency and reduce duplicative costs, while preserving individual claims and defenses.

You may opt out of arbitration within 30 days after first becoming subject to these Terms by sending a clear opt-out notice through the website contact path. The opt-out must include your name, contact information, and a statement that you want to opt out of arbitration.

If you reside in the UK or the EU, mandatory local consumer rights may apply, and any claim that applicable law does not permit to be arbitrated will be handled in the courts required by that law.

General terms

BRIK64 may modify, suspend, or discontinue the site at any time. We may update these Terms by posting revised terms on the site or providing notice where appropriate. Continued use after changes means you accept the updated Terms.

You agree to receive communications electronically. These Terms are governed by U.S. law and Delaware law where applicable, without regard to conflict-of-law rules. If any provision is unenforceable, the remaining provisions remain in effect. You may not assign these Terms without BRIK64's consent; BRIK64 may assign them.

The site and related technical materials may be subject to U.S. export control laws. You may not export, reexport, or transfer technical data or products in violation of applicable export laws.
